Kansas DUI / DWI Law
Kansas uses a tiered DUI system with escalating penalties based on BAC and prior convictions within a 10-year look-back period.
- Standard DUI limit: 0.08% BAC
- Aggravated DUI: 0.15% BAC or higher
- Under-21 limit: 0.02% BAC (zero tolerance)
- CDL drivers: 0.04% BAC limit
- 10-year look-back — prior DUIs escalate charges up to felony
- Also aggravated if child passenger present or injury/death caused
Kansas Distracted Driving Laws
Kansas banned texting for all drivers in 2011. A limited handheld zone law passed in 2026 and awaits the governor's signature.
- Texting while driving: banned for all drivers since January 1, 2011
- Texting violation fine: $60
- Restricted-license drivers: banned from all wireless device use
- No statewide handheld ban for adult drivers (as of April 2026)
- 2026 legislation: bans handheld use in school and construction zones, $60 fine, effective Summer 2027 — pending governor's signature
Important: What This Course Can and Cannot Do in Kansas
No statewide point reduction: Kansas has no defensive driving point reduction program. Completing this course will not remove points from your Kansas driving record.
Ticket dismissal is court-dependent: Some Kansas courts offer diversion agreements that may allow ticket dismissal after completing a defensive driving course — but you must get permission from the court or prosecutor before enrolling. Do not assume dismissal without that approval.
